Agreement
These terms govern your use of MailWatch, operated by MailWatch (“we”, “us”). By creating an account or using MailWatch you agree to them on behalf of yourself and the organization you create or join (“you”). MailWatch is a service for businesses and professionals; consumer protection rules that apply to you by law are not affected.
The service
MailWatch monitors the DNS configuration of your domains (SPF, DKIM, DMARC, MX, MTA-STS, TLS-RPT and BIMI), receives and analyses the DMARC aggregate and TLS reports that mailbox providers send for them, and alerts you about problems. What is included depends on your plan.
MailWatch reports what DNS and mailbox providers tell us. Reports can arrive late, be incomplete or contain mistakes made by the provider
that sent them, and our analysis is advice rather than a guarantee. You remain responsible for your DNS records and mail configuration;
check a change before you publish it, especially before moving a DMARC policy to quarantine or reject.
Accounts and organizations
- Give accurate account details and keep your password and API tokens secret. You are responsible for what happens under your account and tokens.
- An organization's owners control its members, domains and subscription. Members act on behalf of the organization.
- Only add domains you own or are authorised to monitor.
- Tell us at hello@mailwatch.eu if you suspect someone has access to your account.
Acceptable use
You must not:
- use MailWatch to monitor domains you have no right to monitor, or to gather information about other people's infrastructure for attacks;
- send anything to reporting addresses other than DMARC aggregate and TLS reports for your domains, or deliberately send malformed or oversized messages;
- try to access other organizations' data, probe or overload the service, or get around plan limits or rate limits;
- resell MailWatch or its API, except as an agency for your own clients on the Agency plan;
- use MailWatch for anything illegal.
We may suspend access that breaks these rules or endangers the service. Where we can, we warn you first.
Plans, payment and refunds
- The Free plan costs nothing and has the limits shown in the app. Paid plans are billed in advance, monthly or yearly, until cancelled.
- Payments are processed by Creem, which acts as our merchant of record: Creem sells you the subscription, charges your payment method, issues the invoice and handles VAT. Creem's own terms apply to the payment.
- Prices are shown before you pay and exclude VAT where VAT applies. We announce price changes at least 30 days in advance; they apply from your next billing period.
- You can change or cancel your plan at any time from the billing page. A cancellation takes effect at the end of the paid period, after which the Free plan applies.
- Payments are not refundable for partly used periods. If something went wrong, for example you were charged twice or the service did not work, write to us within 14 days of the payment and we will refund you where that is fair.
- If a payment fails and is not resolved, the organization moves to the Free plan. Domains above the Free limit keep working but you cannot add new ones, and history beyond the Free period is no longer shown.
Your data
You own the data in your organization: your configuration and the reports sent for your domains. You give us the right to store and process it only to provide MailWatch to you. You can export it through the API while your plan includes the API, and you can delete domains and their reports at any time. How we handle personal data is described in our privacy policy.
Data processing
Reports can contain personal data, such as the IP address of a mail server run by an individual. For that data you are the controller and we are your processor, and this section is our data processing agreement under Article 28 of the GDPR. We:
- process report data only to provide MailWatch, on your documented instructions (your configuration and use of the service), unless the law requires otherwise;
- make sure everyone with access to it is bound by confidentiality;
- protect it with appropriate technical and organizational measures, as described in the privacy policy;
- use only the sub-processors listed in the privacy policy, bound by equivalent obligations, and announce new ones at least 30 days in advance so you can object by cancelling;
- help you answer requests from data subjects and meet your obligations on security, breach notification and impact assessments;
- notify you without undue delay, and within 48 hours, after becoming aware of a personal data breach affecting your data;
- delete report data at the end of the retention periods in the privacy policy, or within 30 days after your organization is closed;
- give you the information you need to show compliance, and allow audits by you or an auditor you appoint, with reasonable notice and at your cost.
The data concerns the operators of mail servers that send email using your domains; the categories are sending IP addresses, host names, domains and message counts.
Availability and changes
We work to keep MailWatch available and your data safe, but we do not guarantee uninterrupted service. We may need maintenance windows, which we keep short and announce in advance when we can. Reports that arrive while processing is paused are queued and processed afterwards.
We improve MailWatch continuously and may change or remove features. If we remove a feature that a paid plan includes, we tell you in advance and you may cancel with a pro-rata refund of the remaining paid period.
Agencies and clients
On the Agency plan you can manage client organizations and invite your clients' people. You are responsible for having the right to monitor your clients' domains, for the access you give, and for your agreements with your clients. Client organizations use your subscription; if it ends, they move to the Free plan's limits together with you. White-label branding changes how MailWatch looks to your clients, not who provides the service.
Liability
MailWatch is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential damage, such as lost profit, lost email or reputational damage, and our total liability in any twelve months is limited to the amount you paid us in that period (or €100 if you use the Free plan). These limits do not apply to damage caused intentionally or by gross negligence, or where the law does not allow them.
Termination
You can stop using MailWatch at any time: cancel your subscription and ask us to close your account or organization. We may terminate an account that seriously or repeatedly breaks these terms, or end the service altogether with at least 60 days' notice and a pro-rata refund of prepaid fees. After termination we delete your data as described in the privacy policy.
Governing law
These terms are governed by the laws of the country where MailWatch is established, and its courts have jurisdiction, unless the law gives you the right to go to court elsewhere.
Changes to these terms
We may update these terms. We tell organization owners about material changes by email at least 30 days before they take effect. If you do not agree, you can cancel before then; continuing to use MailWatch afterwards means you accept the new terms.
